Title:  Amos Jenney Deed

to Neile Levingston

This Indenture Made the first day of November in the Year of Our Lord One thousand Seven Hundred and forty four, Between Amos Jenney of the County of Fairfax in the Nothern Neck in the province of Virginia Yeoman of the One part, And Neile Levingston of Trenton in the County of Hunterdon and province of New Jersey Yeo: of the other Part, Whereas Mahlon Stacy late of the County of Burlington Deceas’d in his life time And at the time of his Death Was Legally Seized in his Demeasne as of fee, of and in Divers- Mefsuages and tracts of land in and about Trenton as well as in other parts of West Jersey, Who being thereof So Seized Died Intestate after Whose Decease tho Same Descended to his Surviving Sister To Wit, Mary Pownall Ruth Atkinson the Wife of Samuel Atkinson & Rebeckah Potts the Wife of Thomas Potts, and to the Said Amos Jenney the Eldest Son and heir at law to Elizabeth Jenney One of the Sisters of the Said Mahlon Stacy, And to Mahlon Kirkbride the Only Son and heir of Sarah Kirkbride Another of the Sisters of Said Mahlon Stacy Deceas’d And the Said Mary Pownall by deed Dated tho thirteenth of September Anno (1742) Did bargain and Sell Unto Thomas Atkinson all that her right and Share of lands Which Decended to her from her Deceased brother, And the Said Rebeckah Potts by deed dated March the fifth Anno (1742) before She Intermaryed With Said Thomas Potts Did Convey to her Six Children Six Seventh parts of all her rights and Shares of Said lands, And Whereas the Said Amos Jenney by a Certain Instrument Under his hand and Seale and by him Duley Executed did Constitute and appoint his brother Thomas Jenney his true and lawfull Attorney for him and in his Name by Composition Agreement or any legall Means to divide the Said Mefsuages lands and premifses afores’d And after Such Division as partition Made, to Sell And Dispose of all or any part thereof, And for him and in his Name to Grant Signe Seale And as his Act and Deed to Deliver all and every Such Deed or Deeds Conveyance or Conveyances as he Shall think Needfull for Confirming the Same, As by the Said Instrument being Duley proved and Entered in the rolls office of Bucks County in Book B Vol 3’d page xxx that all being thereunto had Will More at large appeare And Whereas it Was Mutually Agreed upon between the parties Concerned therein that part of the land and tenements Should be divided Which Accordingly Was done and Several Lotts or parcel of land in and about Trenton fell to the Said Amos Jenney, And on the Division thereof the parties released to Each Other, As by a release to the Said Amos Jenney from the other parties, relation being thereunto had Will More at large appeare Now This Indenture Witnefseth that the Said Amos Jenney for and in Consideration of the Sum of fifty Two Pounds Current Money of New Jersey for his use, to the Said Thomas Jenney his Said Attorney in hand paid by the Said Neile Levingston the receipt thereof he doth hereby Acknowledge and thereof Doth Discharge the Said Neile Levingston his heirs Executors forever by these presents, He the Said Amos Jenney by his Said Attorney Thomas Jenney Have Granted bargained Sold Aliened Enfeoffed released Conveyed And Confirmed And by these present doth fully Clearly And Absolutly grant bargain Sell release Convey & Confirm Unto the Said Neile Levingston ^to operate by Virtue of the pact of Afsembly for transferring Uses into pofsefsion and to his heirs And afsigns forever, the Quantity of Twenty Acres of land being part of the land released to Said Amos Jenney, as aforesaid, Which is bounded as followeth Viz:  Beginning at a post in the line of Thomas Atkinsons land being Cornor to Thomas Tindals thence along by Said Atkinson South fifty Nine deg’s West Eleven Chains and Twenty links to a post Standing about halfe a Chaine to the Westward of Beakes White Oake Cornor, then North twenty Seven Degrees West Sixteen Chaines & Sixty Links to a post in the line of land Survey’d of to Stacy and Nathan Beakes then along Said line North forty Seven Deg’s ^East Eleven Chaines and Sixty links to a post Cornor to Said Tindal then along his line South Twenty Seven deg’s East Ninteen Chaines And Twenty links to the place of beginning Containing Twenty Acres of land Together With all the Woods Under Woods And all and Singular the Ways Waters rights Liberties Priviledges Hereditaments And appurtenances thereunto belonging, And the reversions and remainders thereof, To have and to hold the Said Twenty Acres of land & Premifses hereby Granted & released or Mentioned to be, With the appurtenances Unto the Said Neile Levingston his heirs and afsigns to the only proper Use and behoofe of the Said Neile Levingston his heirs and afsigns forever, And the Said Amos Jenney for him Selfe his heirs Executors, by his Said attorney Thomas Jenney doth Covenant and Grant to and With the Said Neile Levingston his heirs And afsigns by these presents in Manner following that is to Say that he the Said Amos Jenney Now at the time of the Sealing and Delivery of this present Indenture is the true Sole and Lawfull Owner of the Said land and Premifses hereby Granted or Mentioned to be, With the Appurtenances, And is lawfully rightfully and Absolutly Seized thereof And of every part thereof of a good Sure absolute and Indefeizable Estate of Inheritance in fee Simple Without Any Condition Limitation or other thing to alter Change Determine or Make Void the Same And that he the Said Neile Levingston his heirs and afsigns and every of them Shall and Will from time to time and at all times forever hereafter Lawfully peaceably and quietly have hold Occupy pofsefs and Enjoy the Said land and premifses With the appurtenances Without the lawfull lett Suit Trouble Eviction Ejection or any other Interuption of Any person or persons lawfully Claiming Any part or parcel thereof, And the free & Clear and freely and Clearly Acquited & discharged of and from all and all Manner of former and other gifts grants bargains Sales leases Mortgages Dowers Joynters Entails & of and from all and Singular other titles Charges & Incumbrances Whatsoever, And further that he the Said Amos Jenney and his heirs the Said land and premifses Unto the Said Neile Levingston his heirs and afsigns against all & Every person or persons lawfully Claiming any part thereof Shall and Will Warrant and forever defend by these presents, And that he the Said Amos Jenney and his heirs and every other person having or lawfully Claiming any Estate right title or Intrest of in or to the premifses or any part thereof Shall and Will at any time or times hereafter, at the reasonable request Cost and Charge in the law of the Said Neile Levingston his heirs or afsigns Make Execute and Acknowledge or Cause to be all and every Such further and other Lawfull and reasonable Act and Acts deed or deeds device or devices in law Whatsoever for the further and better afsurance and Confirmation of the premifses hereby granted With the appurtenances Unto the Said Neile Levingston his heirs and afsigns forever, as by the Said Neile Levingston his heirs or afsigns or his or their Council Learned in the Law Shall reasonably devise advise or require, In Witnefs Whereof the party first Named in these presents hath hereunto Set his hand & Seale the day & Year above written
