This Indenture Made this twenty Eighth day of October in the Year of Our lord one thousand Seven hundred and forty Six Between Samuel Burge of the City of Philadelphia Saddler of the one part, and Elijah Bond of Trenton in the County of Hunterdon and Province of New Jersey of the Other part, Whereas David Martin Esq’r High Sheriff of the County of Hunterdon by virtue of two Writs of xxx facias (possibly one word – xxxfacias) (one of them being Ifsued Out of the County Court for Holding of pleas for the County of Hunterdon at the Suit of William Burge against the goods and Chattles lands and tenements belonging to William Trent Esq’r late Deceas’d And the Other Writ was Ifsued out of the Supreame Court of the province (best guess) of New Jersey at the Suit of our Sovereign Lord the King against the Goods and Chattles lands and Tenements belonging to James Trent late of Trenton Deceas’d Did Levy and Seize upon Several tracts and parcels of land lying in Trenton Belonging to the Said William Trent  & James Trent, at the time of each of their Deaths, And the Said David Martin did Expose the Same to Sale by Way of publick Vendue, And the Said David Martin by Indenture Under his hand and Seal bearing Date the Twelvth day of December Anno 1743) for the Consideration therein Mentioned Amongst Other lands Did Grant and Convey a Certain Lot of land or Swamp Unto the Said Samuel Burge Containing five Acres lying in Trenton and Known by the Name of the Seventh Lot, recourse being had to the above recited Will More at large appeared, Now This Indenture Witnefseth that the Said Samuel Burge for and in Consideration of the Sum of Sixty Pounds proclamation Money to him in hand paid by the Said Elijah Bond at and before the Ensealing and Delivery of these presents the rece’t Whereof he doth hereby Acknowledge and thereof Doth Acquit release and Discharge the Said Elijah Bond his heirs Executors and Adm’s forever by these presents, Hath Granted bargained Sold Aliened Enfeoffed released Conveyed and Confirmed and by these presents Doth fully Clearly and Absolutely Grant bargain Sell Alien Enfeoff release Convey and Confirm Unto the Said Elijah Bond and to his heirs and afsigns forever all that the above Mentioned Lot Known by the Name of the Seventh lot Which is bounded as followeth Viz: Beginning at a post Standing by the Two end (best guess) roade being Cornor to lot (No 6) and runs from Thence along Said roade North fifty Eight Degrees Thirty Minut’s East five Chains to a post Cornor to Elijah Bond being lot (No 8) thence along by the Same South Thirty one Degrees thirty Minut’s East Ten Chains to a post Cornor to Said lot Thence South fifty Eight Degrees Thirty Minut’s West five Chains to a post Cornor to Said Lott (No 6) thence along by the Same North Thirty one Degrees Thirty Minut’s West Ten Chains to the place of beginning Containing five Acres, Together With all and Singular the rights Liberties Priviledges Hereditaments and appurtenances to the Same belonging or in any Wise appertaining And all the Estate right title Intrest Property Pofsefsion Claim and Demand Whatsoever of him the Said Samuel Burge and his heirs both in law and equity of in or to the Said lot of land and premifses or any part thereof and the reversions and remainders rents Ifsues and Profits thereof, To Have and to hold the Said lot of land and all and Singular the premifses hereby Granted or Mentioned to be Granted With the appurtenances Unto the Said Elijah Bond his heirs and afsigns to the Only Proper use Benefit and Behoof of the Said Elijah Bond his heirs and afsigns forever And the Said Samuel Burge for him Selfe his heirs Executors and amd’rs Doth Covenant, Grant and agree to and With the Said Elijah Bond his heirs and afisgns that he the Said Samuel Burge Hath Not done Nor Wittingly Nor Willingly Sufferred to be done any Act Matter or thing Whatsoever Whereby or by reason Whereof the above Granted lot of land and Premifses Now are or at any time hereafter May be Defeated Charged or Incumbered in any Estate title Charge or otherwise, And that the Said Elijah Bond his heirs and afsigns Shall and May from time to time and at all times hereafter forever, Have hold use Occuppy and Quietly Pofsefs & Enjoy the Said lot of land and Premifses Without the lawfull let Suit Trouble Eviction Ejection or any Other Interuption Whatsoever of him the Said Samuel Burge or his heirs or of or from or by any Other person or persons Whatsoever Lawfully Claiming by from or under him them or any of them or by his or their or any of their Acts Consents afsents privity or procurement, And Lastly that he the Said Samuel Burge and his heirs and all Claiming Under him or them Shall and Will at all times hereafter During the Space of Seven Years at the request Cost and Charge in the Law of the Said Elijah Bond his heirs or afsigns Make do Execute and Acknowledge or Cause to be, all Such further lawfull Conveyances and afsurances in law for the further and better afsureing and Conveying the Said premifses Unto the Said Elijah Bond his heirs and afsigns forever by Such afsurance As the Said Elijah Bond his heirs or afsigns or his or their Councill learned in the law Shall reasonably devise advise or require Provided Such afsurance Contains No further or other Warranty or Covenant then is herein Contained In Witnefs Whereof the Said Samuel Burge hath hereunto Set his hand and Seal the day and Year above Written Anno Dom 1746.
