This Indenture Made the Tenth Day of May in the Year of our Lord One Thousand seven Hundred and Seventy one Between Benjamin Yard of Trenton in the County of Hunterdon and Province of New Jersey of the one part and Nathan Beakes of Trenton aforesaid of the other part Witnefseth that the said Benjamin Yard for and in Consideration of the Sum of fifty two Pounds current Proclamation Money to him in hand paid by the said Nathan Beakes before the Ensealing and delivery of these Presents the Receipt whereof he the said Benjamin Yard doth hereby acknowledge and thereof and every part thereof doth hereby acquit Exenorate Releafe and Discharge the said Nathan Beakes his Heirs Executors and Administrators forever by thefe Presents hath Granted Bargained and Sold and by these presents doth Grant Bargain and Sell Alien Enfeof Releafe Convey and Confirm unto the said Nathan Beakes his Heirs and Afsigns one certain Lott or piece of Land Situate in Trenton aforesaid Bounded as followeth Beginning at a Stone Standing on the North side of Maidenhead Road being a Corner of Jethro Yards Lott and runs from thence Along his Line North Twenty Nine Degrees West Seventeen Chains and fifty Links to a Stone being another of Jethro Yards Corners standing in the said Nathan Beakes’s Line and from thence runs along his Line North fifty seven Degrees ^East four Chains and sixty five Links to a Stone being Corner to Jofeph Yards Lott now the said Nathan Beakes’s and from thence along his Line South Twenty nine Degrees East Seventeen Chains and fifty Links to a Stone by the side of the aforesaid Maidenhead Road and from thence South fifty seven Degrees West four Chains and Sixty five Links to the place of Beginning Containing seven Acres and three Quarters of Land it being Lott Number five laid down in figure one of Benjamin Yards Plan in the Deed of Division of the Estate of William Yard deceased Bearing Date the Twenty second Day of March in the year of our Lord One Thousand Seven Hundred and forty Nine as by recourfe thereunto had may more full and at large Appear Together with all and singular the Houses Buildings Gardens Orchards Ways Woods Fencings Mines Minerals Meadows Quarries Waters Water Courses Fifhings (Fishings) Fowlings Hawkings Huntings Rights Royalties Liberties Priveledges Hereditaments and Appurtenances whatsoever to the said Lott of Land and premises belonging or in any wise Appertaining And all the Estate Right Title Interest prefent pofsefsions Property Claim and Demand whatfoever either in Law or Equity of him the said Benjamin Yard and Ann his Wife their Heirs Executors And Administrators or either of them of in or unto the said Granted and Bargained Premifes or any part or parcill thereof or any of the Appurtenances thereof with the Reversion and Reversions Remainder and Remainders Rents Ifsues and Proffits thereof and of every part and parcill thereof To Have And to Hold the above Granted Lott of Land and premises with all and every of its Appurtenances unto the abovesaid Nathan Beakes his Heirs and Afsigns to the only proper ufe Benefit and Behoof of him the said Nathan Beakes his Heirs and Afsigns forever And the said Benjamin Yard for himself and for his Heirs Executors and Adminiftrators doth Covenant Promife and Agree to and with the said Nathan Beakes his Heirs and Afsigns by thefe prefents that he the said Benjamin Yard at the time of the Enfealing and Delivery hereof hath in himself good Right full Power Lawfull and abfolute Authority to grant and Confirm unto him the said Nathan Beakes his Heirs and Afsigns the above described Lott of Land and Premifes in manner above mentioned And that he hath not Wittingly or Willingly Committed Omitted Suffered or done any Act Matter or thing whereby or by reafon whereof the above granted Premifes or any part thereof  is are shall or may be Charged Burthened or Incumbred in any manner howsoever And that the said Nathan Beakes his Heirs or Afsigns shall and may at all times forever hereafter Quietly and Peaceably have hold Occupy Pofsefs and Enjoy the above defcribed Lott of Land and premifes with every of the Appurtenances without the Trouble Suit Denial Ejection Moleftation or disturbance of him the said Benjamin Yard his Heirs Executors or Administrators and of and from all and every Perfon or Persons Lawfully Claiming or pretending to Claim by from or under him them or any of them or any otherwife howsoever he the said Benjamin Yard his Heirs Executors and Administrators shall and by thefe presents doth Warrant and forever will Defend And lastly the said Benjamin Yard his Heirs Executors and Administrators Shall and will at all times hereafter at the Request Coft and Charge of him the said Nathan Beakes his Heirs Executors or Adminiftrators Make do Acknowledge and Execute or Caufe to be made done Acknowledged and Executed all and every such further Act And Acts Thing and Things Conveyance and Afsurance in the Law whatsoever for the better more full and perfect Conveying Confirming and Afsuring unto him the said Nathan Beakes his Heirs and Afsigns the above mentioned Lott or piece of Land and Premifes as by him the said Nathan Beakes his Heirs or Afsigns or by his or their Council learned in the Law shall be Advifed Devised or Required In Witnefs whereof the said Benjamin Yard and Ann his Wife as consenting thereto hath to this present Indenture set their Hands and Seals the Day and Year above written
